‍1. Introduction

First Touch provides artificial intelligence-powered sales tools to generate more personalized prospect outreach. This Privacy Policy describes how First Touch collects, uses, and discloses personal information through our website, browser extensions, mobile applications, and related services (collectively, the “Services”). If you do not agree with this Privacy Policy, you should not access or use our Services.

2. Our Role: Controller and Processor

First Touch acts in different capacities depending on the data involved. When our business customers (“Customers”) use the Services to process data about their own prospects, leads, and contacts, First Touch acts as a processor or service provider on the Customer’s behalf, under the terms of the Data Processing Addendum between First Touch and that Customer. If you are a prospect or contact of one of our Customers, see Section 7 below, and please direct requests about your data to that Customer in the first instance. When First Touch collects information directly from you to operate your account, provide billing, secure the Services, or communicate with you, First Touch acts as a controller for that information.

3. Information We Collect

3.1 Prospect and Company Data

First Touch accesses and processes prospect and company data to generate personalized sales outreach on behalf of our Customers. This may include full name, job title, employer, location, contact information, employment history, interests, social media profiles, and other relevant details.

3.2 User Account Information

We collect your name, email, phone number, company, and role when you create a First Touch account. For purchases, our payment processor collects payment details, which we do not retain. We also collect usage data to improve our Services.

3.3 Third-Party Integrations

Integrating with tools like your CRM, email, and calendar allows First Touch to access prospect data to provide our Services and analytics. We only access the minimum data needed, and integrations that grant standing access (such as Gmail, Outlook, or HubSpot) are optional — you can decline them, and you can revoke access at any time from your own Google, Microsoft, or HubSpot admin console.

3.4 Email Access

First Touch has access to track email replies only from First Touch-assisted emails. We do not have access to your historical emails and cannot read your inbox. These emails are anonymized and encrypted for analysis and never saved.

First Touch’s use and transfer of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements. This specifically includes not using any personal data received through Google APIs to develop, improve, or train generalized AI and/or ML models. More broadly, across all of the AI-powered features in the Services — currently backed by OpenAI, Anthropic, Google (Gemini), and Perplexity — First Touch does not permit those providers to use your personal data to train, fine-tune, or otherwise improve their underlying models. AI-powered features are optional and can be turned off at the workspace level.

3.5 Cookies and Tracking

First Touch uses cookies, pixels, and related technologies to recognize you and customize your experience, grouped into the following categories: Essential (required for the Services to function), Analytics (help us understand how the Services are used), Personalization (remember your preferences), and Marketing (measure and improve our own marketing). See our Cookie Policy for the current list of specific cookies and how to manage your preferences.

4. How We Use Information

We use information to: provide our Services; customize and improve user experience; communicate with users; for marketing and advertising; and to comply with legal obligations.

5. Legal Bases for Processing (EEA, UK, and Switzerland)

Where the GDPR, UK GDPR, or Swiss data protection law applies, we process personal data on the following legal bases: performance of a contract, to provide the Services you or your employer has signed up for; legitimate interests, including the interests of our Customers in conducting sales outreach, and our own interests in securing, maintaining, and improving the Services, balanced against your rights and expectations; consent, where required, such as for certain cookies or SMS communications; and compliance with a legal obligation, where applicable. 6. Information Sharing

We may share information with: service providers under contract who help us operate the Services (see our current subprocessor list at docs.firsttouch.com/approved-subprocessors); our Customers, as part of providing the Services to them; and law enforcement, where required by law.

7. Prospects and Other Individuals Who Are Not First Touch Users

If you have never signed up for First Touch, you may still appear in the Services as a prospect or contact of one of our Customers. That information may come from your public professional profile, from data our Customer already had about you, or from third-party enrichment vendors listed on our subprocessor page. Some optional features also work by a Customer placing a script on their own website, which identifies visitors to that website using data matched from public and commercial sources. If you visit a website that uses First Touch this way, the operator of that website, not First Touch, is responsible for disclosing this practice to you, typically through their own privacy policy or a consent notice on their site; First Touch processes the resulting data on that Customer’s behalf. We (or our Customer, depending on the circumstances) typically rely on legitimate interest as the legal basis for this processing. If you would like to be excluded from outreach sent through the Services, or would like to know more about what data we hold about you, please contact us at info@firsttouch.com. Because First Touch is usually acting as a processor for this category of data, we may need to direct your request to the relevant Customer, but we will honor a direct suppression request where we are able to.

8. Managing Your Information

You can access and update your account information through your account dashboard. To review, update, or delete your data, or to make any other privacy request, please email info@firsttouch.com. We will respond to verifiable requests within the time required by applicable law.

9. Data Retention

We retain personal information only as long as we have a business need, to meet legal requirements, or until you ask us to delete it.

10. Security

First Touch uses physical, technical, and administrative safeguards designed to protect your data. However, no method of transmission or storage is 100% secure.

11. Your Privacy Rights

Depending on where you live, you may have rights over your personal data, which may include the right to know or access, correct, delete, or port your data; to opt out of the sale or sharing of personal data or its use for targeted advertising; to limit use of sensitive personal information; and to not be discriminated against for exercising these rights. This includes residents of California, Colorado, Connecticut, Virginia, Utah, and other U.S. states with comprehensive privacy laws, as well as residents of the EEA, UK, and Switzerland. 12. International Transfers

First Touch may transfer your data globally using appropriate safeguards, such as the European Commission’s Standard Contractual Clauses where required.

13. Children’s Privacy

Our Services are not directed to children under 18 and we do not knowingly collect personal information from children.

14. Mobile Terms of Service

The First Touch mobile message service (the “Service”) is operated by First Touch (“First Touch,” “we,” or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time, and your continued use of the Service following the effective date of any such changes constitutes your acceptance of those changes.

By consenting to First Touch’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of First Touch through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program to make any purchase, and your consent is not a condition of any purchase with First Touch. Participation in this program is voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details.

You may opt out of the Service at any time. Text the keyword STOP to +18888946690, or click the unsubscribe link (where available) in any text message. You’ll receive a one-time opt-out confirmation. If you are subscribed to other First Touch mobile message programs, you will need to opt out of each separately, per its own terms. We may change any short code or number used to operate the Service and will notify you of such changes; messages sent to a changed number or short code may not be received.

Wireless carriers supporting the Service are not liable for delayed or undelivered messages. You agree to provide a valid mobile number and to re-register if that number changes.

15. Changes to This Policy

We may amend this Privacy Policy from time to time. We will update the “Last updated” date on this page when we do, and we encourage you to review this page periodically.
